Note: Prior to doing this research on the U.S. federal court system, my experience with courts was limited to local traffic court. It is intended only to give an overview for the uninitiated. I did this research to be able to file a Writ of Habeas Corpus for a friend following the occupation of the Malheur National Wildlife Refuge in 2016.
Article III – Section 1
The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. Source: U.S. Constitution, posted on the congress.gov website
Article III established one court – the Supreme Court as a separate branch of government.
Article III authorized the U.S. Congress to establish all other courts adjudicating federal law.
Congress created the federal courts with the Judiciary Act of 1789.
Initially, 13 jurisdictional districts were created with one federal court and one judge for each district. District courts were given authority to administer justice for crimes and offences committed within their respective districts or upon the high seas. They were also given exclusive original jurisdiction in all civil causes of admiralty and maritime jurisdiction including all seizures under laws of impost, navigation or trade of the US where the seizures are made on waters which are navigable from the sea…; they shall have cognizance concurrent with the state courts in all causes where an alien sues for a tort only in violation of the law of nations or a treaty of the United States;
The 13 jurisdictions were then aggregated into regional circuits – initially three circuits: Eastern, Middle and Southern Circuits. The Eastern Circuit had four district courts. The Middle Circuit had five circuit district courts. The Southern Circuit had two courts. Maine and Kentucky were not assigned to a Circuit.
District courts were authorized to appoint clerks for the court and each clerk was required to take an oath or affirmation that they would faithfully enter and record all of the orders, decrees, judgments and proceedings of the said court.
Each district was authorized to have a Marshal to execute all lawful precepts of the court. The Marshal was given the power to appoint deputies.
Each district was to an attorney or person learned in the law to act as an attorney for the United States within the district.
The Judiciary Act also created the position of the U.S. Attorney General to prosecute and conduct all suits in the Supreme Court and to give his advice and opinion to the President.
The Judicial Conference of the United States is the national policymaking body for the federal courts.
Soviets of the Court System
The Judicial Conference is comprised of the following:
- Chief Justice of the Supreme Court
- Chief Judge from Each Judicial Circuit (9 circuits)
- Chief Judge of the Court of International Trade
- District judge from each Judicial Circuit
The Chief Justice of the Supreme Court is the presiding officer of the Judicial Conference Committee. On any given policy vote of the committee, he has one vote just like the rest of the members of the committee. That’s not a supervisory role.
The law as a remedy for government abuse of the citizenry has been removed from the reach of the American people. Federal District judges are appointed for life. They are rulers over kingdoms of corruption. The Department of Justice is an Administrative Agency comprised of people who are not elected and not accountable to anybody. The Prosecutors within the judicial kingdoms are subjects of the judicial high priest – the District Judge. Advancement in their careers is dependent upon the opinion of the judicial high priest. As corruption of the courts goes, so goes the corruption of the prosecutors, so goes corruption of the country.
In 1980, Congress reorganized the U.S. Customs Court as the U.S. Court of International Trade (94 Stat. 1727). The nine judges of the Customs Court were transferred to service on the new court, the name of which signified its judicial functions and its expanded jurisdiction over cases related to trade.
The Real U.S. Government
The following two groups have control of the country. They are unelected, unaccountable and corrupt.
Administrative Agencies, Federal Law Enforcement and the Federal Courts
It was never my intention to look at the corruption of the Administrative Agencies and the Justice System as a whole but I was drawn into looking when the episode at the Bundy Ranch in Nevada happened. I came in late to the story so I began by doing research connected to the BLM, harrassment of ranchers to get them off their property and to put them out of business. The story was basically over by the time I began to understand what was happening in Nevada.
My involvement with researching the corruption of our system of justice and how our administrative agencies of government were being used as weapons against the American people and their property began with the Hammond Family in Oregon: War on the West. Looking specifically at the federal courts began when Michael Emry was arrested and I found that the search warrant signed by the U.S. Magistrate Judge was invalid because he was not lawfully seated as a judge. He was retired and was not re-appointed according to federal law (see challenge to Search Warrant). The Magistrate Judges work for federal judges but their appointments and duties fall under federal civil service law.
President George Bush’s New World Order
It appears to me that the War on the West began with George Bush’s New World Order. I think it’s pretty safe to say now that our country is being invaded by hoards of illegal aliens – mostly military aged men, that the NWO is the Free Trade Area of the Americas under the United Nations system with governing authority transferred to the regional commissions under the UN.
The starting gun for this episode in the NWO begins with the 1990 Houston Summit of the G7 supported by the following two actions taken by Bush.
Bush Executive Order 12803 – Infrastructure Privatization, April 30, 1992
Does surface ownership supercede water rights, grazing rights, mineral rights? Every square inch of land across the entire planet has some kind of minerals underground. What George Bush’s Executive Order 12803 did was to set up American property owners for theft of property via split estate claims. Ranchers were the first victims of the war on property owners of the United States.
